Under President Trump’s second administration, immigration arrests have reached an all-time high. While his zealous deportation efforts grab headlines, a more insidious tactic has been quietly accelerating this trend – one that threatens to upend the justice system.

At its core, this strategy relies on mass hearings, which were historically used for routine administrative tasks like reading immigrants their rights or scheduling follow-up hearings. In recent months, however, these proceedings have transformed into marathon sessions where dozens of cases are jammed into a single session.

The consequences are stark. According to data from the past quarter, more than 100,000 immigration cases were closed in June alone – with deportation orders issued at an unprecedented rate. Thousands of immigrants received removal orders without ever being given a chance to defend themselves; others were ushered into crowded hearings where they had mere days (or even hours) to prepare.

In Chicago, one judge oversaw 185 fast-tracked cases in a single sitting, compared to the usual 20 per session. Meanwhile, judges’ orders green-lighting deportation have skyrocketed by 120% since March, with absentia removals accounting for over 78% of completed cases last month.

The deliberate scheduling of mass hearings has created a logistical nightmare, forcing up to 611 people to arrive at the courthouse en masse – a recipe for chaos and confusion. Additionally, immigrants are being shuttled into these hearings without ever receiving notice of their new court dates, often unaware that they’ve lost the chance to make their case for asylum or other protections.

The impact on vulnerable populations is devastating. Those who receive absentia removal orders often do so unbeknownst to them, having filed applications for relief in good faith. They’re left unaware that they’ve lost the chance to advance to the next stage where they could argue their eligibility to stay in the US legally – and are now at imminent risk of deportation.

This erosion of due process has far-reaching implications. With nearly two out of every five absentia orders nationwide tied to “mega masters,” it’s clear that this strategy is a potent tool in the Trump administration’s mass deportation campaign. Those immigrants who didn’t show up (often for no fault of their own) have lost their chance to advance to the next stage where they could argue their eligibility to stay in the US legally.

The road ahead looks bleak. With over 20,000 absentia orders issued last month – and nearly two-thirds of all removal decisions from immigration judges resulting in deportation – it’s no wonder that immigration arrests are on the rise. This is a recipe for disaster, one that threatens to upend the very fabric of our justice system.

As the administration continues down this path, we’d do well to remember the words of a wise observer: “The law is a chain of command, and those who command it can change its meaning.” The stakes are high – and so too are the consequences.
